To ensure that, except in limited circumstances, all traffic control workers are paid a wage at least equal to or greater than the prevailing wage they would receive if they were working on a City public works project. (Ord. 3557 § 1, 2023)

Prevailing Wage for Engineering Construction Traffic Control Work: $70.92²

$42.71 (basic hourly rate) + $9.25 (health and welfare) + $11.24 (pension) + $5.20 (vacation and holiday) + $0.80 (training) + $0.48 (Other) = $69.68 (total hourly rate)

$43.83 (basic hourly rate) + $9.25 (health and welfare) + $11.24 (pension) + $3.00 (vacation and holiday) + $0.80 (training) + $2.80 (Other) = $70.92 (total hourly rate)

The Ordinance applies to persons engaged in the stopping, slowing, or otherwise guiding, directing, or controlling of traffic in agreement with a City issued permit.

The following are exempt:

1. Construction, renovation, or repair of a single-family home, duplex, triplex, or accessory dwelling unit.
2. Projects costing $1,000 or less.
3. Work done by an employee of a gas or utility company, where the employee performs 1 hour or less of traffic control work per workday or shift.
4. When prohibited by law, or by state or federal funding source requirement.
5. Public agency employees performing traffic control for a public agency. (Ord. 3557 § 1, 2023)

Violation of this Ordinance may be enforced by the City Manager in accordance with Chula Vista Municipal Code Chaper 1.41.

Examples of remedies can include but are not limited to administrative citations, civil penalties in the amount of up to $120 to each traffic control worker for each day that a violation occurred or continued, reinstatement, payment of wages unlawfully withheld, and attorneys' fees and costs.
